Missouri Controlled Substances 

The state of Missouri has categorized controlled substances into five groups based on their level of addictiveness and risk for abuse among users. These are called “schedules,” and each schedule lists its drugs and/or precursors. How you are charged will depend on many variables, including the schedule under which the drugs found in your possession fall, the quantity found, your intent, and other factors.

Missouri also allows prosecutors to increase punishments for those who are prior offenders, persistent offenders, or persistent misdemeanor offenders. Prior offenders are those with an earlier felony, while persistent offenders are those with two or more prior felony convictions. Persistent misdemeanor offenders are those who have been convicted of two or more Class A or Class B misdemeanors. This means that if you were charged with a Class C felony as a prior offender, the prosecutor may have the option to sentence you under harsher Class B felony guidelines. 

Missouri Drug Crime Penalties

The most serious Missouri drug crime is that of trafficking, including the intent to deliver or the delivery of specific amounts of various drugs, such as heroin, cocaine, LSD, methamphetamine, PCP, and more. It is charged and punished as a Class A or B felony. Possession offenses are generally charged as Class C felonies. Possession of marijuana under 35 grams is charged as a misdemeanor carrying up to a year in jail and/or a fine of $500 up to $2,000 depending on the circumstances.

In some cases, you may be able to avoid jail time through a diversion program, such as drug court, that allows you to undergo rehabilitation. By completing the program and abiding by all of the court’s conditions, you can walk away without a permanent criminal record.
